香港明愛向晴軒危機專線及教育中心屬下的「飛越愛情輔導服務」因應現今社會需要,擴充「飛越愛情網上支援服務」,服務宗旨是讓受愛情困擾的人士,於指定的服務時間內,透過互聯網接受註冊社工為有需要人士提供網上情緒支援服務。
The “Love Infinity Counselling Service” under the Crisis Hotline and Education Centre of Caritas Family Crisis Support Centre has transformed the Love Counselling hotline into an online support service in view of the outbreak of COVID-19 pandemic. The purpose of the service is to allow people who are troubled by love issues to receive online emotional support services from registered social workers through internet during the designated service hours.

服務使用條件 CONDITIONS ON THE USE OF THE SERVICE
任何人士如欲使用「飛越愛情網上支援服務」(以下簡稱為“服務” ),必須先細閱以下詳情。
Anyone who wants to use the "Love Infinity Online Support Services" (hereinafter referred to as the "Service"), must first read the following details.

凡進入瀏覽或使用此服務者(以下簡稱為“服務使用者”),將被視作同意遵守此等服務條款(以下簡稱為“服務條款”)以及私隱政策(以下簡稱為“私隱政策”),而此等服務條款和私隱政策以下簡稱為“條款”。
Anyone who accesses or uses the Service (hereinafter referred to as the "Service User") will be deemed to have agreed to abide by these terms of service (hereinafter referred to as the "Terms of Service") and the privacy policy (hereinafter referred to as the "Privacy Policy"), and the Terms of Service and the Privacy Policy are hereinafter collectively referred to as the "Terms".

此等條款規管服務使用者瀏覽及使用本服務。 如對這些條款有任何疑問或有其他投訴、建議,可電郵至fsloveinfinity@caritassws.org.hk查詢。 若服務使用者不同意接受本條款約束,請勿使用本服務,並可考慮使用24小時明愛向晴熱線18288。 如服務使用者不欲接收我們發送的訊息,可隨時輸入「停止」以示退出。
The Terms govern the access and use of the Service by the Service User. If the Service Provider has any questions about the Terms or have other complaints or suggestions, please contact Caritas Family Crisis Line and Education Centre (hereinafter referred to as the “Centre”). If the Service User does not agree to be bound by the Terms, please do not use the Service. If the Service User does not want to receive messages sent by us, the Service User may contact the Centre.

條款修訂MODIFICATION OF THE TERMS
為確保本服務行之有效並符合法規,此等條款會不時修訂,任何修改一經在本網頁刊載則屬即時生效。 服務使用者每次使用本服務時,也可以閱讀最新修訂的條款。 修訂之條款上載在本網頁後,如服務使用者使用本服務,則表示服務使用者接受有關之修訂。
In order to ensure that the Service works effectively and in compliance with laws and regulations, the Terms may be revised from time to time, and any modification will take effect immediately once it is posted on this webpage. The Service User can read the latest version of the Terms every time when the Service User uses the Service. The Service User's use of the Service after any modification of the Terms have been posted will constitute an acceptance of the revised Terms.

各位請注意,參與服務並不等同接受醫療/精神治療或輔導服務,而服務使用者與我們之間也不構成律師和委託人、醫生和病人、或其他類別之持牌專業人士和客戶的關係。 換句話說,我們的服務並非取代專業醫護人員或由其他持牌專業人士(例如:律師)所提供的服務。藉此呼籲各位應尋求專業意見,尤其是對於生理與心理健康狀況有問題時,應該要向家庭醫生或其他合資格的醫護人士徵詢意見。 假若你的健康或情緒狀態瀕臨危急狀況,請立刻通知你的家人或由本服務社工代為致電999求助。
Please note that the Service User’s participation in the Services does not constitute medical or psychiatric treatment or counselling services, and our relationship with the Service User does not constitute an attorney-client relationship, a doctor-patient relationship, or any other sort of professional relationship between a licensed professional and its client. The Service is not a substitute for services provided by professional medical staff or other licensed professionals (for example, lawyers). We urge the Service User to seek professional advice from family doctors or other qualified medical personnel, especially when he or she has problems with his or her physical and mental health. If the Service User’s health or emotional state is close to critical condition, please notify the Service User’s family immediately or the social worker of the Service will call 999 for help.

若遇到任何服務使用者表示會傷害自己或他人,或服務使用者表示將進行刑事罪行,香港明愛向晴軒會考慮及轉介服務使用者至有關政府部門或機構。服務使用者明白, 除非事件涉及生命危險或罪案, 服務使用者於使用本服務時所提供的任何資料及訊息將被保密。
If any Service User indicates that he or she will harm himself or herself or others, or the Service User indicates that he or she will commit a criminal offence, the Centre will consider and refer the Service User to relevant government departments or authorities. The Service User acknowledges that any information and data provided by the Service User when using the Service will be kept confidential, unless in life-threatening or crime situations.

使用本服務的風險 RISKS OF USING THE SERVICE
服務使用者須承擔使用本服務帶來的所有風險。 本服務的社工對於服務使用者或第三方正在使用服務/使用服務之後/由於使用服務 /基於服務所載或提供的訊息,而所下的決定和後果以及所作的行動,一概不須負上責任。 當中包括服務使用者根據本服務提供的資訊而接受或拒絕專業服務、更改或終止已經開始的特別治療。 此外,如(a)你違反“條款”、 (b)你觸犯法律、 (c)由第三方力證服務使用者違反“條款”的有關指控、 (d) 服務使用者透過本服務提供訊息,或(e) 服務使用者使用本服務之情況下遭受損失或令本服務受到影響,服務使用者同意會給予我們賠償及免除我們承擔賠償的責任。 在不影響上述權利下,服務或其營辦機構均無須承擔任何特殊性、意外性、後果性、或懲罰性的損失。
The Service User assumes all risk for the use of the Service. The social workers of the Service take no responsibility for any decisions made, consequence of the decisions made, or actions taken, by the Service User or a third party while using the Service / after using the Service / as a result of using the Service. This includes whether the Service User, based on the information provided by the Service, accepting or rejecting any professional services, changing or terminating special treatments that have already commenced. In addition, the Service User agrees to indemnify us and hold us harmless if we suffer any loss or the Service is affected due to (a) any breach of the Terms by the Service User, (b) any violation of the law by the Service User, (c) any claims asserted by third parties that the Service User is in breach of the Terms, (d) any information provided by the Service User through the Service, or (e) the use of the Service by the Service User. Without limiting the foregoing, in no event shall the Centre or its operating organization be liable for any special, accidental, consequential, or punitive losses.

本服務是依「現況」及「現有」基礎提供。 服務及其營辦機構明確否認所有明示或暗示的保證和條件,並且不保證或陳述服務: (a)能夠達到服務使用者的要求; (b)能夠無間斷、準時、安全、無誤、無故障、無病毒及準確;(c) 能夠符合服務使用者的期望。 上述免責聲明適用於各種損失和責任,包括故障、錯誤、遺漏、干擾、操作或傳送瑕疵和延誤,無論是否因違約、侵權行為以及疏忽或其他原因造成。
The Service is provided on an “as is” basis and “as available” basis. The Centre and its operating organization expressly disclaim all warranties and conditions of any kind, whether express or implied and make no warranty or representation that the Service will (a) meet the requirements of the Service User; (b) be uninterrupted, timely, secure, error-free, bug-free, virus-free and accurate; (c) meet the expectations of the Service User. The above disclaimer applies to various losses and liabilities, including those caused by any failure of performance, error, omission, interruption, defect or delay in operation or transmission, and whether caused by any breach of contract, tortious behavior, negligence or any other reasons.

只供合法使用 FOR LEGAL USE ONLY
服務使用者同意僅在合法用途下使用服務,並且不會侵犯、限制或禁止任何第三方瀏覽本網站的權利。 該等限制或禁止意指在使用服務服務時做出包括但不限於非法行為,或對任何人造成騷擾、困擾或不便,以及傳送淫褻或令人反感的資訊,或阻礙正常的對話流程。
The Service User agrees to use the Service only for lawful purposes, and will not infringe, restrict or prohibit any third party’s right to browse this website. Such restriction or prohibition includes, without limitation, conduct which is unlawful or which may harass or cause distress or inconvenience to any person and the transmission of obscene or offensive material or disruption of normal flow of dialogue while using the Service.

如服務涉及其他參加者,為保障其他參加者的私隱,活動期間不得以任何電子形式記錄及分享活動過程(包括但不限於錄影、錄音、螢幕截圖或拍攝)。如因任何原因以致服務使用者獲取其他參加者的任何資料(包括但不限於個人影像、對話錄音),不論該獲取是人為或技術引起的問題,服務使用者必須立即刪除相關資料。
If the Service involves other participants, in order to protect the privacy of other participants, the activity process shall not be recorded or shared in any electronic form during the event (including but not limited to video recording, audio recording, screenshot or shooting). If for any reason, the Service User obtains any data of other participants (including but not limited to personal images, conversation recordings), regardless of whether it was obtained due to human error or technical problem, the Service User must immediately delete the relevant data.

如果服務使用者 (a)違反“條款”或者 (b)我們認為另外一些服務更適合服務使用者,我們可以在任何時間單方面終止服務使用者使用本服務。
We may unilaterally terminate the access of the Service User to the Service at any time, if (a) the Service User violates the Terms, or (b) we determine that other services are more suitable for the Service User.

服務使用者自行承擔風險 SERVICE USER IS AT HIS/HER OWN RISK
儘管已經有這些保障,但互聯網仍未達至徹底安全可靠的地步,因此我們無法保證能阻截入侵者闖入系統。 服務使用者同意使用本服務,提供資料時會自行承擔潛在的風險,並且同意如果發生非法闖入系統的事件,服務及其營辦機構將無須負上任何法律責任。
Despite these protections, the internet remains an imperfectly secure environment, and we cannot guarantee protection from intruders or interceptors. The Service User agrees to use the Service and submit information at his/her own risk. The Service User also agrees that the Centre and its operating organization will not be liable for any unauthorized access.

儘管我們禁止任何服務使用者非法或擅自取得其他服務使用者的個人及保密資料,我們無法保證服務使用者的所有資料將不會外泄。服務使用者同意使用本服務時,即代表服務使用者同意承擔上述風險。如因使用本服務而引起服務使用者個人資料外泄情況,服務及其營辦機構將無須負上任何法律責任。
Although we prohibit any Service User from illegally or arbitrarily obtaining the personal and confidential information of other service users, we cannot guarantee that all information of the Service User will not be leaked. When the Service User agrees to use the Service, it means that the Service User agrees to bear the above risks. If the personal data of Service User is leaked due to the use of the Service, the Centre and its operating organization will not bear any legal liabilities.

管轄法律 GOVERNING LAW
“條款”及本服務的規則將只受香港法律管限,並須按照香港法律解釋而且不受法律衝突原則管制。 香港明愛和服務使用者均同意對於本服務引起或有關連的一切事務和爭議,皆由香港法院的專屬司法管轄權管轄。
The Terms and the rules of the Service are governed solely by, and shall be construed in accordance with, the laws of Hong Kong and not subject to principles of conflict of law. Caritas Hong Kong and the Service User both consent to submit to the exclusive jurisdiction of the Hong Kong courts over all matters and disputes arising out of or in connection with the Service.

本服務於香港營運,若服務使用者身處香港境外的地方,請注意服務使用者提供的資料將會在香港收集、轉移到香港,並依據香港法律使用。 一旦服務使用者使用服務 向我們提供資料即表示服務使用者同意上述的資料收集、轉移和使用。
The Service is operated in Hong Kong. If the Service User is located outside of Hong Kong, please be aware that any information provided by the Service User will be collected in or transferred to Hong Kong and used in accordance with the laws of Hong Kong. By using the Service and/or providing us with information, the Service User consents to such collection, transfer, and use of information.

可分割性及完整協議 SEVERABILITY AND ENTIRE AGREEMENT
若法院裁定“條款”任何規定無效或不可執行,則該規定將會在最大的許可範圍內執行,而“條款”的餘下部分仍具有完全效力。“條款”構成服務使用者和服務之間的完整協議,並取代其他書面或口頭協定或諒解。
If a court finds any provision of the Terms to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible and the remaining provisions of the Terms shall remain in full force and effect. The Terms constitute an entire agreement between the Service User and the Centre which superseded any other written or oral agreements or understandings.

語言LANGUAGE
“條款”以[中文]書就,可能翻譯成其他語言。如”條款”的[中文]版本與翻譯版本有歧異,概以[中文]版本為準。
The Terms are written in Chinese and may be translated into other languages. If there is any discrepancy between the Chinese version and the translated version, the Chinese version shall prevail.

“Personally Identifiable Information” is any data or information that can be used to identify you, directly or indirectly, including but not limited to your full name, location, home address or online identification code, one or more personal unique factors such as physical, biological, genetic, mental, economic, cultural or social characteristics. When you use the Service, we shall collect your personally identifiable information, including but not limited to your name or address. When you contact us via website, email, phone, etc., we may save the relevant communication records.

You may have to go through a “channel” (for example, Zoom, Google Meet, Cisco Webex or Facebook, depending on the needs of the Service) in order to use the Service. Different "channels" will provide us with specific personal information, which is to be determined by the individual "channels" (i.e. third parties). In any case, the "channel" will specify the shared information on the permission page. You should refer to the privacy policies of individual "channels" to understand their practices.

We also collect non-personally identifiable information, that is, those data that do not have characteristics that can directly identify or contact the parties, such as age, gender, language, region, volume and average length of conversations. We may collect, use, transfer and disclose non-personally identifiable information for different purposes including improving the Service.

披露資料予第三方或直接營銷Disclosure of Information to Third Parties or Direct Marketing
除非下列任一情况下,我們在未獲得閣下同意下將不會披露閣下的個人資料予第三方,或用於直接促銷活動或其他與本服務無關的用途:
(A)遵循法律規定、法庭傳召、法庭頒令、或司法程序;
(B) 保障本服務僱員或代理人的利益、權利、安全或財產;
(C) 履行本服務條款; 或者
(D) 解決詐騙、安全或技術問題,或要確保本服務及基礎設施系統正常運作。
Except in any of the following circumstances, we shall not disclose your personal information to third parties without your consent, or use it for direct marketing activities or other purposes unrelated to the Service:
(A) to comply with the laws, court summons, court orders or legal proceedings;
(B) to protect the interests, rights, safety or property of the employees or agents of the Service;
(C) to perform the terms of use of the Service, or
(D) to resolve fraud, security or technical issues, or to ensure normal operation of the Service and infrastructure systems.

In any of the above circumstances, we may hand over your personal information to the competent authority and/or your immediate family members or guardians in order to protect your vital interests.

查閱、改正及刪除個人資料Access to, Correction and Erasure of Personal Data
根據《個人資料(私隱)條例》(第486章),閣下有權要求查閱及改正閣下向本服務提供的個人資料。另一方面,我們或會因應閣下查閱資料要求而產生的行政及實際成本而收取合理的費用。
According to the Personal Data (Privacy) Ordinance (Chapter 486), you have the right to request for access to and correction of your personal data provided to the Service. On the other hand, we may charge reasonable fees based on the administrative and actual costs incurred by your data access request.

閣下如要求查閱、改正或刪除個人資料,必須使用之前與我們聯絡時所用的同一“渠道及同一帳戶”,以便我們核實屬於閣下的個人資料。
If you request to access, correct or delete personal information, you must use the same channel and same account that you used to contact us before so that we can verify your personal information.
